Please read these conditions before using our website or purchasing a service.

Orchid of Siam provides its website and services subject to these conditions. By using this website or purchasing a service from Orchid of Siam, you accept these terms.

Defined terms

"Client", "you" and "your" mean the individual visa applicant using our services. "Service" means the personalised immigration or visa service agreed with Orchid of Siam. "Working Day" means a day on which banks are open for business in the UK. "Website" means orchidofsiam.org.uk.

Confidentiality

Communications between Orchid of Siam and its clients are treated as confidential and will not be disclosed to a third party unless authorised by the client or required by law.

Licence and website access

Orchid of Siam grants you a limited, revocable and non-exclusive licence to access this website for personal use. You may not reproduce, resell, commercially exploit, frame, scrape, data-mine or modify the website or its content without our express written permission.

You may link to the home page provided the link does not present Orchid of Siam, its services or its affiliates in a false, misleading, derogatory or offensive way. Our logo may not be used without written permission.

Electronic communications

When you email us or submit a website form, you agree that we may communicate with you electronically, by telephone or by post as appropriate. Electronic notices and disclosures satisfy any requirement that communications be in writing.

Copyright

Unless otherwise stated, text, graphics, logos, images and other website content belong to Orchid of Siam or its content suppliers and are protected by applicable copyright and trademark laws.

Information and provision of services

Website and consultation forms help us understand your circumstances but may not ask every relevant question. We may request further information. The scope, timing and deliverables of a paid service will be explained to you and may vary with the complexity of your case.

You are responsible for providing complete, accurate and current information and for supplying requested evidence in time. Advice is specific to the client and must not be relied upon by another person whose circumstances may differ.

Fees and third-party charges

Our service fees must be paid as agreed before work starts. Unless expressly stated otherwise, our fees do not include Home Office, British Embassy, visa application centre, testing, medical, translation, postal, courier or other third-party charges. Those charges can change without notice and are payable separately.

Refunds

Payment engages Orchid of Siam to provide the agreed service. A refund request received by email before work starts and within 24 hours of payment may be considered at our discretion. Once work has started, or after that period, fees are not refundable merely because a client cannot or decides not to proceed.

Where a discretionary refund is approved, an administration charge of £25 or 10% of the amount paid, whichever is higher, may be deducted to cover payment processing and administration.

No guarantee of a visa or work permission

Orchid of Siam is a private immigration advice provider and is not part of the UK Government. We cannot grant a visa, status or work permission. The final decision rests with the relevant government authority, and using our services does not guarantee a successful outcome.

You should not make non-refundable travel arrangements until the relevant permission has been issued. Orchid of Siam is not responsible for loss caused by travel arrangements made before a decision.

Legal and policy changes

Advice is based on the information you provide and on legislation and policy available when the service is delivered. Immigration law and policy can change. We are not responsible for an inaccuracy caused by a later change or by information that was not publicly available at the relevant time.

We provide immigration advice only. Information about tax, business, education, investment or another specialist field is general information and should not replace advice from a suitably qualified professional.

Termination

We may stop providing a service where the website is misused, false or misleading information is supplied, these terms are breached, or professional obligations require us to do so.

Disclaimer and limitation of liability

The website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Orchid of Siam excludes implied warranties relating to the website and is not liable for indirect, incidental, punitive or consequential loss arising from its use.

Nothing in these terms excludes liability that cannot lawfully be excluded. Where liability can be limited, Orchid of Siam's aggregate liability connected with a service will not exceed the amount the client paid for that service.

Associated Bangkok office

The Bangkok office is separately owned and managed. It is not regulated by the OISC, whose jurisdiction applies to advisers in the UK. Fees quoted on this website relate to applications handled through our Epsom office unless stated otherwise.

Governing law

These terms are governed by the laws of England and Wales. Any dispute relating to the website or a service is subject to the jurisdiction of the courts of England and Wales.

General

Headings are for convenience and do not affect interpretation. If any provision is invalid or unenforceable, the remaining provisions continue in effect. We may update these terms, and continued use of the website is governed by the version then published.

Due to privacy obligations, we cannot discuss a client's personal details with a sponsor, relative or another third party without the client's written authority unless the law permits or requires it.
